Certificate of Use for Sidewalk Cafés

A Certificate of Use (COU) for sidewalk cafés authorizes the use of public sidewalk space in front of a restaurant in the District. It ensures that an outdoor dining area is safe, accessible, and compliant with District regulations. Below is an overview of the COU process.

What Is a Certificate of Use (COU)?

A COU is an official permit that allows restaurants to operate sidewalk cafés on public property. It confirms that the outdoor dining setup meets District zoning, safety, and accessibility standards.

Why Is a COU Needed?

Because sidewalks are city-owned, restaurants must have a COU to legally use this public space for outdoor dining.

How to Submit a COU Application

Carefully follow these seven steps to ensure a smooth and timely approval process:

  1. Fill Out the COU Application: All information must match supporting documents to avoid delays.
  2. Confirm Public Space Rental Account and Fees: Ensure all public space account and rental fees are current by contacting The District Department of Transportation (DDOT) and the Office of Tax and Revenue (OTR). An active account is required; DDOT can help set it up.
  3.  Submit an Approved DDOT Sidewalk Café Permit: An active permit is required. Permits starting with “B” are outdated and a name change must be applied for here.
  4. For Renewals Only, Include the Prior COU.
  5. Submit a Current Certificate of Occupancy (COO): This must confirm the use of a restaurant. The restaurant name on the COO and DDOT sidewalk café permit must match. In case of a discrepancy, the restaurant must update records with DDOT and DOB.
  6. Provide a Valid Certificate of Liability Insurance. It must list the District of Columbia as certificate holder with this address:1100 4th Street SW, Washington, DC 20024.
  7. Submit the Application and Documents.
    • Email the completed application and all required documents to: [email protected], using the subject line: "CU – [Property Address for the COU]."
    • Allow one business day for review and approval.

How to Renew a COU

  • A COU must be renewed every year to continue operating the sidewalk café legally.
  • Renewal applications can be submitted via email before the COU expires. As noted above, the application package must include the prior COU.

What Happens After Approval?

Once approved, the restaurant will receive its official COU via email.

How Much Does a COU Cost?

  • The COU application is $286.
  • The Certificate is valid for one year and must be renewed annually.
